Legal Solutions To Common Long-Term Care Medicaid Problems (LIVE WEBINAR) -- March 30-31, 2021

In this course, we will explore creative legal solutions to common obstacles in obtaining Medicaid eligibility for long-term care patients, as well as what can be done in the event of a Medicaid denial. Initially, we will examine Section 19-344(c) of the Health General Article of the Maryland Code, and learn how long-term care facilities can use this provision to access documents and ensure payment of available income without petitioning for guardianship.

Next, we will review the COMAR provisions pertaining to appeal of a Medicaid denial and discuss what can be expected during an appeal hearing. We will also explore what can be argued when appealing denials for excess resources or failure to submit documentation. Finally, we will look at Guardianship of Property as a means of preventing denial of Medicaid eligibility in certain cases and explore how the collections process works when there are no options for securing coverage.
